2. HIPAA and Texas Medical Privacy Compliance

Care Impact Group is committed to protecting the privacy and security of Protected Health Information (PHI) in accordance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Texas Medical Records Privacy Act (TMRPA), codified in Chapter 181 of the Texas Health and Safety Code.

2.1. Protected Health Information (PHI)

If you are a covered entity or business associate under HIPAA, or a patient providing PHI, you agree:

To only provide PHI through secure, designated channels outlined by Care Impact Group.
That Care Impact Group shall act in accordance with its HIPAA and TMRPA compliance protocols, including implementing administrative, physical, and technical safeguards.

2.2. Texas Medical Records Privacy Act (TMRPA)

Under TMRPA, Care Impact Group is required to:

Provide notice explaining that an individual’s PHI could be disclosed electronically.
Obtain authorization for certain disclosures that would be permitted by the HIPAA Privacy Rule.
Respond to patient access requests for electronic health records within 15 business days.
Prohibit the sale of PHI for any reason other than treatment, payment, healthcare operations, or maintenance operations permitted by the Insurance Code.
The materials on the Company's website are provided on an 'as is' basis. The Company makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Violations of TMRPA may result in civil penalties of up to $250,000 per violation, in addition to any fines issued by the U.S. Department of Health and Human Services for HIPAA violations.

2.3. Business Associate Agreements (BAA)

If required, Care Impact Group is willing to enter into a Business Associate Agreement (BAA) with clients or partners that are subject to HIPAA and TMRPA regulations. Please contact us directly to discuss and execute a BAA prior to sharing PHI.

2.4. No Medical Advice

The Website is not intended to provide medical advice or diagnosis. Any content provided on the Website is for informational purposes only and should not be construed as a substitute for professional medical advice, diagnosis, or treatment.
